Supervisor Bradford called the Regular Meeting of the Columbia Township Board to order. Present were Bradford, Burgett, Nuismer, Hurley, and Harrington. In attendance were 16 citizens.

Consent Agenda: Regular Meeting Minutes-July 21, 2009; Special Meeting Minutes- None; Planning Commission Meeting Minutes-July 20, 2009; bills through August 18, 2009; Treasurer’s Report. Motion by Burgett, second by Hurley, to approve the Consent Agenda. Carried unanimously.

Clerk: Bills paid after the Consent Agenda. Pabis-425; Verizon-76.36; West Shore-8376.94; Mi.Twp.Serv.-68.75; Hancock Ins-200.00. Motion by Burgett, second by Nuismer, to approve the bills paid after the consent agenda. Carried unanimously.

Public Comment: H.Johnson-During the fire on 14th, the tanker could not get water from Stokes pond. The officers are not in leadership courses.

Fire Chief: 5 calls received in July: 1 brush fire; 2 accidents; 1 assist to CEMS; 1 canceled enroute. Average response time was 4.0 minutes.

Sheriff: 60 complaints received in July: 2 assault; 2 breaking & entering; 3 larceny; 3 MDOP; 1 obstructing justice; 2 public peace; 4 traffic violations; 6 health & safety; 2 invasion of privacy; 1 runaway; 4 accidents; 5 alarm activation; 1 accident-explosion; 1 civil/property dispute; 13 general assistance; 2 att pick up; 8 be on the look out.

State Police: No Report.

County Commissioner: No Report. Thanks to Todd Oliver for the prompt action for the breaking & entering in Breedsville.

Planning Commission: No Report.

Neighborhood Watch: Next meeting-September 3, 2009-7:30 pm. Watch out for scams.

Hospital: Book Fair-8/11-12; Volunteers are needed; Daniel & Gretchen Barnas have joined the staff; MS Support Group-second Tuesday monthly; Healthy Heart Cooking-8/13; Cooking Classes-8/17-20 & 8/21; Look Good, Feel Better-8/31; Kids Night of fun-8/21.

South Haven Senior Services: No Report.

Recreation/Cemetery: No Report.

Zoning Administrator: 5 Zoning Compliances issued in July: 1 reroof; 1 modular; 2 pole barns; 1 dormer.

New Business: 1. Motion by Burgett, second by Hurley, to be closed September 5th. Carried unanimously. 2. Motion by Burgett, second by Nuismer, to send the revised Master Plan to the surrounding communities & the county Planning Commission. Carried unanimously. 3. Motion by Bradford, second by Burgett, to approve installation of the guardrail on 50th St. Carried unanimously. 4. Motion by Burgett, second by Hurley, to approve Resolution 2009-22, Closing of District Court. Roll call vote: Bradford aye, Burgett aye, Nuismer aye, Hurley aye, Harrington aye. Carried unanimously. 5. Motion by Bradford, second by Burgett, to appoint Laura Beckwith as the Columbia Township SHASS Representative. Carried unanimously. 6. Motion by Burgett, second by Nuismer, to approve Resolution 2009-21, Budget Amendment. Roll call vote: Bradford aye, Burgett aye, Nuismer aye, Hurley aye, Harrington aye. Carried unanimously.

Public Comment: D. Nuismer-checking into different banking accounts. R.Hurley-looking into fencing that is similar to Breedsville Cemetery.

 

Brian, the township attorney said there was no problem going into closed session without adding it to the agenda.

Motion by Bradford, second by Burgett, to go into closed session to discuss pending litigation with the township attorney at 7:30 pm. Roll call vote: Burgett aye, Hurley aye, Nuismer aye, Hurley aye, Harrington aye. Carried unanimously.

Motion by Burgett, second by Bradford, to authorize the township attorney & Dale Bradford to meet with Ken Speicher & his attorney to explore a resolution to the lawsuit. Carried unanimously.

Motion by Burgett, second by Bradford, to authorize the township attorney to appeal judge Buhl’s ruling. Carried Unanimously.

Motion by Nusimer, second by Hurley, to adjourn. Carried Unanimously.
