WHEREAS, Columbia Township has a Policy, No. 2004-01, prohibiting any person to carry a concealed weapon into the Columbia Township Hall, except for authorized police personnel, and

WHEREAS, based on the Michigan Court of Appeals case entitled Michigan Coalition for Responsible Gun Owners, et al, vs City of Ferndale and Karen Pedro, Docket No. 242237, released for publication April 29, 2003, which holds that a local unit of government is prohibited from enacting and enforcing any ordinances or regulations pertaining to the transportation and possession of firearms, because the local unit is preempted by State statute;

THEREFORE, BE IT RESOLVED, that Policy No. 2004-01 entitled "Concealed Weapons" be repealed as contrary to state law.

The foregoing resolution offered by Board Member Burgett and supported by Board Member Fogarty.

Upon roll call vote, the following voted.  Beckwith aye; Burgett aye; Fogarty aye; Harrington aye; Hurley aye.

The Supervisor declared the resolution adopted.
